The cost of having a construction dispute resolved, or uncertainty about those costs, prevents many people from recovering money that they are properly entitled to be paid under building and construction contracts.

About the Presenters:

Paul O’Brien

Paul is the General Manager Commercial – New Zealand and Pacific at McConnell Dowell Limited.

Prior to joining McConnell Dowell, Paul held national commercial roles at Dominion Constructors, Fletcher Construction, Leighs, Hawkins and Mainzeal. He has over 35 years’ experience in the construction industry with more than half of that time spent in New Zealand. He is also a director of Construction Information Limited (Masterspec).

Paul is a Chartered and Registered Quantity Surveyor, holds an Honours Degree in Law from the Open University, a Graduate Diploma in Law from Auckland University and is a graduate of the EY Darden Business School Executive Management Programme. He is a Fellow of the New Zealand Institute of Quantity Surveyors and a Member of the Royal Institution of Chartered Surveyors, the New Zealand Institute of Building and the Institute of Directors. He is also an Associate member of both the Arbitrators’ and Mediators’ Institute of New Zealand and the Chartered Institute of Arbitrators.

Paul has represented companies in mediation and participated as both a claimant and defendant in adjudication, arbitration, and litigation. He has been appointed to provided expert evidence in adjudication, arbitration and litigation proceedings, including on a matter before the New Zealand Court of Appeal.

John Green

John is a Director of the Building Disputes Tribunal.

John is an arbitrator, adjudicator and mediator based in Auckland, New Zealand. He has been appointed in more than 1,300 building, construction and infrastructure disputes over the past 34 years relating to residential, commercial and industrial construction projects, power stations, gas fields, manufacturing and processing plants, stadiums, hotels, land subdivisions, roading, railways, wharves, marinas, drainage, dams, water and wastewater treatment plants, recycling plants, mining, services, and utilities, involving domestic and internationally based parties, complex technical and legal matters, and sums in dispute exceeding $100M.

John is the founder and a Director of the Building Disputes Tribunal, the nationwide, specialist dispute resolution service provider for the building and construction industry in New Zealand and an Authorised Nominating Authority under the Construction Contracts Act 2002.

John was appointed as a mediator and an adjudicator for the Weathertight Homes Resolution Service in 2003, when the Government service was formed, and acted as an adjudicator until 2012. He is a member of the NSW Government Adjudication Research and Reporting Unit Advisory Panel and the International Statutory Adjudication Forum. He is an Honorary Life Member of the Society of Construction Law New Zealand for his contribution to the practice of construction law and an Honorary Life Member of the Arbitrators’ and Mediators’ Institute of New Zealand for his contribution to dispute resolution.

John has published and presented widely on dispute resolution. He was the founding editor of BuildLaw® and ReSolution® and he is the author of Thomson Reuters: ‘The Leaky Building Crisis: Understanding the Issues’ – Part 4 Dispute Resolution Options and the ‘Unit Titles Manual’ – Chapter 14 Dispute Resolution. He specialises in dispute resolution process design, development and delivery.
